Commercial Contracts

I had a guy call me up tonight to order our book, and in the process of the conversation he mentioned he needed help writing a contract for a commercial client. The contract is due Monday and while a couple of people sent him samples, he can't modify the pdf files. I told him to send the samples my way and I'd type/design something up for him to use for now.

I am a writer/graphic designer, NOT a contractor. So while I can make it pretty, I don't know what NEEDS to go on it. What items do I need to be sure to include?

No problem a few of the basics. What they will be cleaning some proposals have check boxes I prefer to put it in writing exactly what I am going to do its more personal. Consistency of services and usually it runs a year. One of the most important things is the disclamer he will probaly need to get with you on exactly what he wants wether it says he is responsible for nothing or otherwise. The disclamer can be a touchy situation I would probaly have him write one where you can cut and paste. Area for any special instructions and terms of service(payment due within 15 days after 15 so on. Hope this helps

Always make sure their is a part that say's "Owner/Tenant/Client to allow unobstructed access to water source". Sometimes the owner or client assumes that the contractor is providing is the water for the job and therefore assumes that the price includes the water. With this disclaimer the owner/client understands that not only are they suppliying the water, they must make sure the water sourc(s) are not locked or hindered in any way such as parked cars.

Also, make sure to leave an area that outlines or details pre exisiting conditions or damages to a builing or parking area. Paint Flaking, Gashes in walls, Gutter Damage, Broken Concete, etc and more should all be listed and pictures taken.

These are two areas that I see most often neglected in proposal forms.
