Vinnie, the odds of any of us giving you the correct advice are nil. why? Because each state has different laws about lien law. Go to a lawyer, your local contractor association, or identify which state you work in.

Most states require you to wait at least 30 days before you can file. Until then, call the customer every single day.

We have a big blue stamp that says past due on it place it on envelope 99% time customers pays quickly . Always try to get work number . We send the sheriff with a warrant from the court to the job address payment is in the mail by court date . Never been to court . In the letter sent with past due on it we place info about court fees and our collection fees that they neglected to read on the bottom of the contract.
